The object of this book is to establish that the "orthodox" view, that English law does not permit non-charitable purpose trusts, is in fact heresy. Paul Baxendale-Walker has investigated this subject both historically and geographically, beginning with a thorough examination of the old authorities supporting non-charitable purpose trusts, followed by a demolition of the supposed objections to them, and ends by taking the reader on a world-wide tour of those jurisdictions where the legislature, assuming there to be a common law rule against purpose trusts, has passed statutes to permit them. After reading this book it can no longer be asserted that we have a rule against purpose trusts, based on the highest authority. Practitioners and academics alike will learn much from this thought-provoking book.
