La tirannia dei valori
Carl Schmitt war ein Mann des polemischen Traktats, der Streitschrift, des Pamphlets. Zu seiner eigentlichen literarischen Form fand er in dem, was die Franzosen einen ›brûlot‹ nennen: ein entflammbarer Text, ein Boot mit hochentzündlicher Fracht, dazu bestimmt, das Schiff des Gegners in Brand zu setzen. Ein solcher ›brûlot‹ ist die Schrift über die »Tyrannei der Werte«. Der Titel enthält bereits die ganze These. Werte können dem Gemeinwesen und seinem Recht keinen festen Grund bieten, sie verschärfen vielmehr dessen Probleme. Gerade wenn man von ihnen erwartet, sie sollen Gemeinsamkeit stiften, wirken sie zerstörerisch. […] Der jungen Bundesrepublik, in der man sich nach der tiefen Verunsicherung durch Nationalsozialismus und Krieg gern und viel auf Werte berief, liest Carl Schmitt auf diese Weise die Leviten. So scheinbar klar seine zentrale These daherkommt, so rasch drängen sich dem Leser freilich grundsätzliche Fragen auf. Auf welcher Ebene bewegt sich Schmitts Argumentation eigentlich? Geht es um politische Philosophie, um allgemeine Ethik oder um Verfassungsrecht und Verfassungsgerichtsbarkeit? Schmitt selbst gibt einen Hinweis, wenn er »Überlegungen eines Juristen zur Wert-Philosophie« ankündigt. […] Sein Text wählt von vornherein eine schwierige Zwischenlage zwischen Philosophie und Jurisprudenz. 149 books502 followersCarl Schmitt's early career as an academic lawyer falls into the last years of the Wilhelmine Empire. (See for Schmitt's life and career: Bendersky 1983; Balakrishnan 2000; Mehring 2009.) But Schmitt wrote his most influential works, as a young professor of constitutional law in Bonn and later in Berlin, during the Weimar-period: Political Theology, presenting Schmitt's theory of sovereignty, appeared in 1922, to be followed in 1923 by The Crisis of Parliamentary Democracy, which attacked the legitimacy of parliamentary government. In 1927, Schmitt published the first version of his most famous work, The Concept of the Political, defending the view that all true politics is based on the distinction between friend and enemy. The culmination of Schmitt's work in the Weimar period, and arguably his greatest achievement, is the 1928 Constitutional Theory which systematically applied Schmitt's political theory to the interpretation of the Weimar constitution. During the political and constitutional crisis of the later Weimar Republic Schmitt published Legality and Legitimacy, a clear-sighted analysis of the breakdown of parliamentary government Germany, as well as The Guardian of the Constitution, which argued that the president as the head of the executive, and not a constitutional court, ought to be recognized as the guardian of the constitution. In these works from the later Weimar period, Schmitt's declared aim to defend the Weimar constitution is at times barely distinguishable from a call for constitutional revision towards a more authoritarian political framework (Dyzenhaus 1997, 70–85; Kennedy 2004, 154–78).
Though Schmitt had not been a supporter of National Socialism before Hitler came to power, he sided with the Nazis after 1933. Schmitt quickly obtained an influential position in the legal profession and came to be perceived as the ‘Crown Jurist’ of National Socialism. (Rüthers 1990; Mehring 2009, 304–436) He devoted himself, with undue enthusiasm, to such tasks as the defence of Hitler's extra-judicial killings of political opponents (PB 227–32) and the purging of German jurisprudence of Jewish influence (Gross 2007; Mehring 2009, 358–80). But Schmitt was ousted from his position of power within legal academia in 1936, after infighting with academic competitors who viewed Schmitt as a turncoat who had converted to Nazism only to advance his career. There is considerable debate about the causes of Schmitt's willingness to associate himself with the Nazis. Some authors point to Schmitt's strong ambition and his opportunistic character but deny ideological affinity (Bendersky 1983, 195–242; Schwab 1989). But a strong case has been made that Schmitt's anti-liberal jurisprudence, as well as his fervent anti-semitism, disposed him to support the Nazi regime (Dyzenhaus 1997, 85–101; Scheuerman 1999). Throughout the later Nazi period, Schmitt's work focused on questions of international law. The immediate motivation for this turn seems to have been the aim to justify Nazi-expansionism. But Schmitt was interested in the wider question of the foundations of international law, and he was convinced that the turn towards liberal cosmopolitanism in 20th century international law would undermine the conditions of stable and legitimate international legal order. Schmitt's theoretical work on the foundations of international law culminated in The Nomos of the Earth, written in the early 1940's, but not published before 1950. Due to his support for and involvement with the Nazi dictatorship, the obstinately unrepentant Schmitt was not allowed to return to an academic job after 1945 (Mehring 2009, 438–63). But he nevertheless remained an important figure in West Germany's conservative intellectual scene to his death in 1985 (van Laak 2002) and enjoyed a considerable degree of clandestine influence elsewhere (Scheuerman 1999, 183–251; Müller 2003).

Carl Schmitt explains tribal warfare on social media, almost 50 yrs before Twitter was invented. Also pithy critique of both Nietzsche and the attempt by existential Humanism et al. to overcome him.
"Die Geltung der Werte beruht auf Setzungen [...] Danach ist es das menschliche Individuum, das in voller, rein subjektiver Entscheidungsfreiheit die Werte setzt. Auf diese Weise entgeht es der absoluten Wertfreiheit des wissenschaftlichen Positivismus und setzt ihm seine freie, das heißt: subjektive Weltanschauung entgegen. Dei rein subjektive Freiheit der Wertsetzung führt aber zu einem ewigen Kampf der Werte und der Weltanschauungen, einem Krieg aller mit allen, einem ewigen bellum omnium contra omnes, im Vergleich zu dem das alte bellum omnium contra omnes und sogar der mörderische Naturzustand der Staatsphilosophie des Thomas Hobbes wahre Idyllen sind [...] Denn das Spezifische des Wertes liegt eben darin, daß er statt eines Seins nur eine Geltung hat [...] Wer sagt, daß sie gelten, ohne daß ein Mensch sie geltend macht, will betrügen.
Haben die neuen objektiven Werte den Alpdruck behoben, den Max Webers Schilderung des Kampfes der Wertungen bei uns hinterlassen hat? - Sie haben es nicht, und sie können es auch nicht. Sie haben - ohne die objektive Evidenz für Andersdenkende auch nur im geringsten zu vermehren - durch ihre Behauptung des objektiven Charakters der von ihnen gesetzten Werte nichts anderes getan als ein neues Moment der Selbstverpanzerung in den Kampf der Wertungen eingeführt, ein neues Vehikel der Rechthaberei, das den Kampf nur noch schürt und steigert [...] Das alles zeigt nur die Verwirrung der ganzen Wertargumentation, die fortwährend neue Relationen und Gesichtspunkte aufwirft, dabei jedoch in der Lager bleibt, dem Gegner den Vorwurf zu machen, daß er offensichtliche Werte nicht sieht, mit anderen Worten: ihn als wertblind disqualifiziert."

«In questa svalutazione nichilistica, paradossalmente, il carattere di esclusività dei valori alimenta l'intransigenza delle contrapposizioni e le trasforma in opposizioni morali, assolute, non negoziabili: chi aderisce a valori opposti rispetto a quelli ritenuti corretti è considerato nemico, e merita solo di essere annientato. La logica dei valori soffia sui fattori polemogeni e porta dritto al conflitto discriminante. Un individuo, un gruppo, una etnia, se armati di valori, sono potenziali assassini. Bisogna perciò discriminare la spirale dei valori e rinunciare a una sovradeterminazione morale dell'agire politico».

Tenía la sensación de que había varias versiones de este texto. La intuición se confirmó.
En esta edición, se presentan cuatro textos. El primero, en sí mismo, un ensayo de gran profundidad analítica, revela el genio de Jorge Dotti. Es increíble que grandes estudiosos de la obra schmittiana no fueran conocidos antes por causa de las fronteras nacionales y tecnológicas. Dotti mostró, tal vez lo que Schmitt nunca se atrevió a decir: que la (anti)teología política liberal judaica es antitética a la teología política cristiana: cualquier intento de libertarios, liberales o conservas de superar este hiato se torna ridículo por imposible. El judío, en su exclusividad, busca no tener sino las relaciones estrictamente necesarias con los goyim, pero, a la vez, como pueblo dedicado a Dios, no puede sino tener lealtad a éste y por tanto, privilegiará las relaciones de mercado, por neutralizadoras; el judío, más allá de la fidelidad que pueden tener algunos miembros del "pueblo elegido" a sus nuevas patrias, no puede aquél sino ser un intruso en ellas. Schmitt, opone a la lógica liberal judaica la cristiana, cuyo ejemplo paradigmático es la Iglesia.
El liberalismo tiende a evitar la institucionalización. De ahí, la matriz de la Reforma, que niega que la Iglesia sea una institución legítima para ser interlocutora entre Dios y los hombres. Claro, Dotti explotó más el contraste entre ambas visiones del mundo y explicó de refilón cómo los valores, en tanto intento de superación del positivismo, terminaron por convertirse en la base del nihilismo y de la violencia irrestricta.
En este libro, se presentaron las dos versiones del ensayo schmittiano "Tiranía de los valores": el primero enfatizó el choque de utilizar los valores para cuestiones jurídicas, el segundo, fue más un estudio filosófico, donde destacó el fuste torcido de la filosofía de los valores. No pueden comprenderse ambos documentos sin leer el ensayo de Ortega y Gasset sobre aquéllos.
El volumen cerró con un ensayo de Dotti.

Das überflüssige Wort zum Sonntag.
Die Gefahr der Wertlogik liege darin, dass Werte kein Sein haben, sondern nur eine Geltung. Es ist das Individuum, das Werte setzt - und das heißt immer: durchsetzt; gegen andere Werte, gegen andere Menschen. Laut Schmitt ist dabei kein Platz für Hinsichten: Der höhere Wert schlägt den niederen Wert unbedingt und insofern ist für seine Durchsetzung kein Preis zu hoch. In Bezug auf den Krieg heißt das: Der Krieg wird total, wenn er im Namen bestimmter Werte geführt wird. Dann ist der Kriegsgegner kein Kontrahent mit eigenen Interessen, sondern ein zu vernichtender Träger von Unwerten - tradierte Kategorien des Kriegsrechts fänden dann keine Beachtung mehr.
Das Nachwort erhellt Absicht und Reichweite der eigentlich unspektakulären kleinen Schrift. Auslöser ist die Interpretation des Grundgesetzes als einer Wertordnung. Demgegenüber soll das Recht als autonomer Bereich der Vermittlung vor dem Einfluss der jeweiligen Großideologien bewahrt werden. Zurecht wird darauf hingewiesen, dass die von Schmitt unterstellte Aggressivität der Werte in auffälligem Gegensatz zur Realität der frühen BRD steht und vor dem Hintergrund des NS-Engagement Schmitts tief ironisch wirkt. „So beschwört er nun Maß und Mitte des Rechts, der erprobte Ideologe rät zur Ideologieabstinenz.“ Vielleicht Entlastungspose? Oder doch eine Kritik von und Warnung vor Legitimierungsstrategien, die Schmitt kennt, weil er ihnen selbst fatal verfallen war? All das ergibt sich erst aus dem Nachwort, das also alleinig lesenswert ist.

In this book we can see an Carl Schmitt concerned about the moral questions incorporated in the judicial argue and he´s clare in affirming that under the values´s logic these are made effective but aren´t justified, delving in that question.

En este libro podemos ver a un Carl Schmitt preocupado por las cuestiones morales incorporadas en la argumentación judicial y es claro al afirmar que bajo la lógica de los valores estos se hacen efectivos pero no se justifican, ahondando en esa cuestión.

A text that should be read together with Political Theology, as it shows how "political theology" is a criticism of the positivistic conception of value following Weber. Still, Schmitt shows how Weber's thought carries sources that may help us criticize such a positivistic conception.
