The Kesavananda Bharati Case :The Untold Story of Struggle For Supremacy by Supreme Court and Parliament

This book recounts the tensions and conflicts in the Kesavananda Bharati case not only between the rival sides but also amongst the judges some of whom had preconceived views because of being judges in the earliest cases and others by reason of their selection by Government. It also reveals the stratagem of the Chief Justice S M Sikri on the date of the judgments by which he fortuned on a paper hurriedly prepared by him. It also shows how later cases of the Supreme Court have distilled the concept of the basic structure of the Constitution and how it has been considered in other jurisdictions.

It is a bit difficult for me to rate non-fiction, especially a book which is a retelling of the past, present and future of the Kesavananda Bharti Case yet there is no reason for me to not give it five stars. I did not have to worry about taking the facts and research with a grain of salt due to the credentials of T.R Andhyarujina. The author was the Solicitor-General of India from 1996-1998 and Advocate-General of Maharashtra from 1993-1995. He also appeared in the Kesavnanda Bharti Case. Comprising of just 150 pages, the book is direct, to-the-point and wonderfully precise in its analysis. I knew about the case superficially so this was a great opportunity for me to understand the political overtones affecting the judgment. This would not be a great pick for someone who doesn't know anything about Indian Constitutional law because there is some prerequisite knowledge of articles and amendments required. Besides this, I can see myself re-reading this annually.

The go to book for securing a clear understanding of the circumstances under which the case was decided and the legal contours of the decision. Lucidly described. Makes for a marvelous read.

A must read for all interested in Law and the judiciary. Not a great work of art or literature, but certainly gives you valuable insights into what transpired in the Supreme Court of India and the power corridors of Delhi before during and after the landmark case which safeguarded the rights of every Indian.

Kudos to the author for unveiling the enigma from a case which has never been nor will ever be witnessed by the legal and political history of this nation. The intricacies have been brought out in the open in a spectacular fashion, a delicacy which will be relished by generations to come. A bible for lawyers..
