When your client calls (if you’re an attorney) and says, I wasn’t speeding, he or she probably was. I never knew a cop, deputy or trooper that wrote a ticket that wasn’t what they believed to be correct. But I knew allot them who probably didn’t memorialize the information enough to win a true jury trial. This is where you the lawyer or the person who intends to represent yourself comes into the picture. Since most jurisdictions consider these simple tickets a criminal offense, the violator has the right to ensure his or her conviction is supported beyond a reasonable doubt. I will say this; if you get to trial you have probably already lost. It has been my experience and probably yours too, that judges and juries believe the cops! What this advice is intended to do is keep you and your client from ever having to go to court. I want to tell you the administrative issues that officers are supposed to complete to support the violations they write.
