About the author

Professor Jasser Auda is a founding member and Head of the Dawah Committee at the International Union of Muslim Scholars, a member of the European Council for Fatwa and Research, and teaches and supervises research on Maqasid Al-Shariah at the Faculty of Islamic Studies in Doha. He has a PhD in the Philosophy of Islamic law from the University of Wales, UK, and a PhD in systems analysis from the University of Waterloo, Canada, and a M.Jur. thesis on the Maqasid/purposes of the Shariah from the Islamic American University. Early in his life, he had studied Fiqh, Usul, hadith, Sunnah, and memorized the Quran in the halaqas of the Azhar Mosque in Cairo. He was previously a founding Director of the Maqasid Center in the Philosophy of Islamic Law in London, a founding Deputy Director of the Center for Islamic Legislation and Ethics in Doha, and a professor in the Faculty of Law, Alexandria University, Egypt, Islamic Fiqh Academy of India, American University in Sharjah, University of Waterloo, Canada. He lectured on Islam and its law and ethics in dozens of universities and institutes around the world, and wrote a number of books, some of which were translated to fifteen languages.

- هذه رسالة المؤلف للدكتوراه، وعززت لدي انطباعي السابق الذي تكون عندما قرأت له رسالته للماجستير فقه المقاصد واطلعت بعدها على عدد كبير من محاضراته في المقاصد، الرجل مستواه عادي في المضمون ومتجدد في الشكل (جداول ورسومات توضيحية وكلام شكله فخم..) ولكن من ناحية المضمون هو نسخة تقليدية من تيار معروف صرت تتوقع نتائجه مسبقا (أعني بالتيار المدرسة المتبنية للمقاصد -بشكل نظري على الأقل-، وتشكيلة الفتاوى التي كان منبعها "المجلس الأوروبي للإفتاء") مع ضعف ظاهر في الاستدلال على آراءه؛ كمية كبيرة من الحجج الخطابية، وحيدة عن أس أدلة المخالفين، وتصور تقليدي لتطور الفقه وكيفية نشأته (ترديد لسردية مشهورة ولكنها غير دقيقة) وكذلك فهم غير دقيق لآراء كثير من المتقدمين، أظن -ولست متيقنا- أن سبب آخر مشكلتين هي اعتماده في تصور الأصول والأقوال الفقهية على المتأخرين (أبوزهرة ، صلاح سلطان) ثم تجميع ما يسند نظرته من كتب المتقدمين .. في الفصل الأخير من الرسالة عرض المؤلف رأيه في العديد من القضايا بعد أن كانت الفصول السابقة أغلبها وصفي وتحليلي لآراء الآخرين، وفي الفصل هذا مضمون مختلف عن المضمون التقليدي من المدرسة المقاصدية المعتادة.. إلا أنه في مجمله مضمون ضعيف ومعالجات تزيد الطين بلة مبنية على تصورات خاطئة في تقديري (نزعة تشكيكية في الفقه تحاول إضعاف اليقين أوسحبه من هذا الباب بالكلية وعلى كافة مستوياته بآليات مختلفة؛ كفصل الوحي عن الفقه تماما، إنكار الإجماعات ودلالتها في الفقه، تبني شروط الرازي العشرة للقول بقطعية النصوص بل والزيادة عليها ! ..)

- فكرة تأريخ الأفكار وسرد أسباب نشوء المدارس وأهم سمات وملامح المناهج، أمر يستهويني كثيرا، ولكن هذا السرد يحتاج إلي مبدع يحسن استخلاص الخطوط العامة والمنعطفات الرئيسية من جزئيات كثيرة يتتبعها بدقة تخدم سرديته التي انتهى إليها، وهنا أجد تفاصيل كثيرة تعارض النظرة العامة التي سردها المؤلف .. قارن هذا -مثلا- ببحث أيمن صالح : أهل الألفاظ وأهل المعاني؛ دراسة في تاريخ الفقه .. كيف يكون تتبع التفاصيل قائدا إلي نظرية أكثر إقناعا/تفسيرية من النظرية السائدة.

كخلاصة قاسية: تجديد في الشكل، مضمون عادي غالبا والجديد فيه غالبا ركيك وحججه خطابية، ٢.٥ من ٥ .

A strong introduction to Maqasidi approach to Fiqh, but a bit too technical and takes very long to get to the point.

The author started the discussion on his research by presenting a historical survey of the theory of maqasid as-syariah, beginning with the post-prophetic era and until modern times; starting with the companion's ijtihad, especially Omar's, Abu Zayd al-Balkhi, al-Qaffals, Ibn Babaweah al-Sadouk, Al-Juwayni, al-Ghazali until al-Shatibi, who developed the theory to its classic form. He then discussed the contemporary conceptions of Maqasid theory from different approaches; Traditionalism, Islamic Modernism and Postmodernist approaches. Finally, his work presented a system approach to the theories of Islamic Law, in which the proposed system features (cognitive nature, wholeness, openness, interrelated hierarchy, multi-dimensionality and purposefulness) are realised via specific theoretical suggestions. Most of the discussions above are illustrated with diagrams and charts which are very helpful in bringing the understanding to the readers in a very creative way.

I find this book very useful from the point of differentiating the various ways Islamic scholars interpreting the nusul (their methodology) to bring up hukum or fatwa, which some scholars nowadays are taking fatwa from the previous opinions, without considering other factors that could lead to another appropriate opinion. In fact, they assume the methodology is the fundamentals of Islamic Law and fixed, hence cannot be argued or changed (which is wrong). Dr Jasser Auda managed to look into the details of the methodology and proposed the maqasid syariah as the very essence of Islamic Law via the systems approach and should be the essence of all the theories.

Jasser Auda dikenal sebagai seorang pakar Maqashid Syariah, yaitu sebuah ilmu tentang bagaimana kita bisa memahami maksud atau tujuan dari syariah atau hukum yang diterapkan dalam Islam. bukunya ini termasuk pelopor dalam kajian Maqashid Syariah karena beliau melakukannya dengan pendekatan sistem. jadi, sejauh mana efektifitas dari Maqashid Syariah, dilihat dari sejauh mana pencapaian dari tujuan itu sendiri, atau secara sederhananya adalah kita bisa melihat dan mengetahui efektifitas sistem hukum islam dilihat dari sejauh mana pencapaian maqashid syariahnya. inilah yang disebut dengan problem solving yang disediakan oleh Islam terhadap berbagai problem dan permasalahan sosial dan individual.

Buku ini, meski detail dan deskriptip, pada beberapa pembahasan cenderung sangat teknis sekali sehingga membuatnya menjadi kaku dan membosankan. tapi, selebihnya, banyak hal yang bisa dipelajari dari buku ini. dan yang lebih penting, buku ini juga menyoroti ushul fiqh dan kesimpulan hukumnya dari berbagai mazhab yang diakui (ada 8 ; 6 Sunni, 2 Syiah, 1 muktazilan dan 1 zahiri). sehingga membuatnya menjadi kaya akan rujukan dan luas secara perspektif. tapi, tidak terkesan sebagai perbandingan mazhab. Penulis hanya memberikan faktual dari sistem setiap mazhab tersebut, yang mau tidak mau, untuk menyesuaikan dengan zaman, metode2 penarikan hukumnya juga harus lebih disesuaikan, mengingat keragaman dan kerumitan dari setiap kasus atau problemnya itu sendiri.

Di buku ini pula, anda akan mendapatkan beberapa pengetahuan kunci dari zaman sebelum adanya generasi imam (pendiri mazhab) hingga kontemporer. untuk yang kontemporer, tidak banyak ulama yang mendalami kajian tentang Maqashid syariah selain sebagiannya saja. seperti Thahir Ibn Asyur, Yusuf al-Qaradhawhy, dan lainnya.

"سأورد رأيي وفهمي للكتاب بإيجاز"

الفصل لاول:
يتحدث عن هدف الكتاب وهو تفعيل مقاصد الشريعة في استنباط الاحكام والفتاوى لتحقيق المرونة والتفاعل مع حياة الناس المعاصرة

الفصل الثاني:
طرح بعض المشكلات السياسية والاقتصادية التي أصابت الفقه بالجمود والتحيز للحاكم المستبد ورجل السياسة ،، والتي بدورها أدت إلى حروب ونزاعات سببها الفهم القاصر لبعض فقهاء تلك العصور

الفصل الثالث:
أعتذر إن لم يتضح لكم المقصود !! لأنه في هذا الفصل تحدث بتشعب عن علم المنظومات وعلم الكلام والتي تساعد في تأصيل نظرية المقاصدية في التشريع ،، في هذا الفصل تهت بعض الشيء ،، ،، ولم استطع الالمام به بشكل كامل

الفصل الرابع والخامس:
هما قلب الكتاب وزبدته ،، تحدث المؤلف - وأورد أمثلة يشكر عليها لتوضيح الافكار - ،، في هذين الفصلين ،، بتوسع في تبيان الفروقات بين المذاهب في فهمهم للنصوص الكتاب والسنة ،، كيف أن بعض المذاهب من خلال تقديسهم لرأي الامام ،، قد يعطلون المقصد الشرعي من النص ،، وبعضهم أيضا يعطي حجية العقل مركزا أعلى من النص ،، وهذا يتعارض مع غالبية المذاهب.

أيضا تطريق في هذين الفصلين ،، إلى تأثير الفلسفة اليونانية على بعض العلماء والمحدثين ،، مثل الغزالي وإبن رشد ،، وكيف قادتهم دراستهم لتلك الفلسفة إلى فهم أشمل للفقه ،، خاصة فيما يتعلق بمقاصدية الشريعة

ويزخر الكتاب ببعض الامثلة المشينة والمحزنة ،، والتي تسببت بها النظرة الاستبدادية للحاكم التي جمدت دور الفقه وجعلته أداة مغلفة بالدين للإستمرار في استبداده وطغيانه بمباركة من الفقيه الذي أهمل دوره الاساسي والمرجو!

الفصل الاخير هو ملخص شامل لفصول الكتاب المتقدمة وفيه تبيان موسع لبعض النقاط التي أجل المؤلف الحديث عنها حتى هذا الفصل .

من أقيم الكتب التي يمكن للمسلم المشغول بوضع الإسلام كدين ومنظومة فكرية داخل المناخ الفكري و الفلسفي الحديث أن يقرئها.

يقدم الكتاب فى أغلب فصوله عرض مقارن بين نظريات الفقه والتشريع والإسلامي عبر التاريخ ومواطن قصورها وكيف أن هذه النظريات إما تقف موقف المتجمد المتأخر عن منتجات العقل البشري الحديث، أو - على الجانب الآخر - موقف المفرط فى كل الأصول.

ومن ثم يطرح الكتاب رؤية جديدة للفقه تنطلق من مفهوم المقاصد العليا للشريعة وتتخذ من نظرية المنظومات آلية للعمل.
الجديد فى هذه فى الرؤية ليس الانطلاق من مقاصد الشريعة الكلية للتحرر من تاريخية الألفاظ والسياقات التشريعية، ولكن المثير للاهتمام حقاً هو المنهجية المنظومية فى التعامل مع الشريعة الإسلامية ومع الواقع المحيط بها، حيث تستطيع تلك المنهجية أن تتعامل بكفاءة مع درجة التعقيد الحقيقة التي تتسم بها ارتباطات مكونات الشريعة مع بعضها ومع الواقع التي تعيش فيه، بشكل يمكن العقل الفقهي من التحرر من التفكير الخطي التقليدي المتجلي قى مفهوم القياس إلى رؤية لاخطية أشمل وأكثر اعتباراً لتعدد العوامل والمؤثرات وتفاعلاتها المتبادلة وتأثيراتها على الحكم والفتوى.

استفدت استفادة عظيمة من هذا البحث، وأنا على ثقة بأني سأستفيد منه ثانية إذا أعدت قرائته. ولهذا لي عودة مرة أخرى معه إن شاء الله بعد التوسع فى الاطلاع على عدد من المصادر المذكورة فى الكتاب، خصوصا ً كتب الطاهر بن عاشور.

Great and detailed explanations on the concept of maqasid. What interests me most is how Dr Jasser Auda applies systems approach and social theories to study Islamic laws. Indeed a great resource for researchers

An interesting and unique look at the world of Usool Al-Fiqh and Maqaasid Ash-Shariah, proposing new methods to deal with contemporary Fiqh issues. I'd recommend this for advanced students of knowledge who can read it critically.
