After a series of trials, Burns was sentenced to death and hanged at Ararat Gaol Victoria Australia on Tuesday 25 September 1883 still claiming his innocence. After the execution, hangman Elijah Upjohn claimed Burns confessed while being pinioned "I've cooked eight altogether, and now you are going to cook me".
