The very first Habeas Corpus writ filed in India, after Emergency period was, Prof. Eacharavaryar vs Govt of Kerala. Verdict of the suit toppled then State Government, resulted in resignation of CM, and is still the exemplar of Police brutality and Human Rights violation. This book is an autobiographical account by T.V. Echaravaryar (Eswara Warrier) himself, of his relentless and lonely legal struggle for justice and truth behind the unaccounted disappearance of his son P. Rajan in Police custody.
Emergency period (1975-1977) was notorious for curbing of civil liberties, police brutality, imprisonment of political opponents and press censorship. P. Rajan, a student of Regional Engineering College, Calicut (Now known as NIT Calicut) was arrested by Kerala Police without verification, citing alleged Naxal association and was brutally tortured in custody, and was killed. The interrogation is said to have employed the extreme torture practice of ‘uruttal’ (rolling); Rajan’s body was disposed of and was never recovered, and by the classic book excuse of no body-no conviction, DIG later managed considerable legal escape.
Rajan’s Father Prof. Warrier immediately filed petition asking for his son’s whereabouts and made repeated enquiries, with all references he could garner. Authorities were condescending towards Prof. Warrier, for his son was branded as a Naxalite, an anti-national of the highest kind. Media during that time, modulated and biased, and a sorry censored excuse for Press, was mostly antagonistic towards his search.
Over the course of events, a lot of contradicting claims have been made by Police, from denying the arrest altogether to accusing Rajan of murder. Anyway accused was never brought in front of Magistrate. After emergency, on habeas corpus, Police finally confirmed Rajan’s death in custody, K Karunakaran, who was the Home Minister during Emergency, was forced to resign from the post of CM which he had pledged only two months before and DIG Jayaram Padickal was convicted and arrested. Prof. Warrier continued his legal battle to expose the state sponsored atrocities during the Emergency period, and has been a significant figure in human rights till his death.
A striking feature of the book is Prof. Warrier ‘s catholicity in reporting incidents of such personal trauma. He writes about it all, and pleads with readers, not to judge the people involved based on his remote experiences, for he has to write the truth. Though he was never involved in, Rajan sympathized with the cause, and Warrier doesn’t hide this fact from readers. He also mentions previous mental incidents his wife had. Though Rajan’s disappearance escalated her condition to death, Warrier doesn’t try to use it to strengthen his narrative. The compensation amount from case was directed to sponsor a critical care ward in Ernakulam General Hospital, in Rajan’s memory. Rest of the money was donated to University as youth festival endowments, to commemorate Rajan’s interest in arts.
This book might not reach many people, for its written language- Malayalam (an English translation is available now, DRM free I believe), but nevertheless it is a struggle for democracy and fundamental rights against the autocracy and plutocracy it tend to get reduced to.

ചാത്തമംഗലം റീജിയണൽ എഞ്ചിനീയറിംഗ് കോളേജിൽ പഠിച്ചുകൊണ്ടിരുന്ന പി രാജൻ. രാത്രി ഫാറൂഖ് കോളേജിൽ യൂത്ത് ഫെസ്റ്റിവലിൽ പങ്കെടുത്തശേഷം രാവിലെ ആർ ഇ സി ഹോസ്റ്റൽ മുറ്റത്ത് കോളേജ്ബസിൽ കൂട്ടുകാരോടൊപ്പം വന്നിറങ്ങിയ രാജനെ പോലീസ് പിടിച്ചുകൊണ്ടുപോയി. തലേദിവസം കായണ്ണ പോലീസ് സ്റ്റേഷൻ ആക്രമിച്ചു തോക്ക് കവർന്ന സംഭവം നക്സലൈറ്റുകളുടെതാണെന്നും, രാജന് നക്സൽ ബന്ധമുണ്ടെന്നും, ആ സംഭവത്തിൽ ഉൾപ്പെട്ടിട്ടുണ്ടെന്നും അനുമാനിച്ചാണ് പിടിച്ചുകൊണ്ടുപോയത്.

ഉരുട്ടൽ പ്രയോഗം നടത്തി ഒടുവിൽ പുലിക്കോടൻ നാരായണൻ എന്ന പോലീസ് മേധാവി ചവിട്ടി കൊല്ലുകയായിരുന്നു.
അന്നത്തെ മുഖ്യമന്ത്രിയായിരുന്ന സി.അച്യുതമേനോനും ആഭ്യന്തര മന്ത്രിയായിരുന്ന കെ കരുണാകരനും തന്നോടു കാണിച്ച വിശ്വാസവഞ്ചനയും ക്രൂരതയെപറ്റിയും അദ്ദേഹം വിശദമായി ഇതിൽ പ്രതിപാദിച്ചിട്ടുണ്ട്.
ഈച്ചരവാര്യരുടെ നീണ്ടുനിന്ന നിയമ പോരാട്ടങ്ങൾക്കൊടുവിൽ രാജൻ കസ്റ്റഡിയിൽ മരിച്ചു എന്ന് ഹേബിയസ് കോർപ്പസ് സമർപ്പിച്ചതിനു മേൽ പോലീസ് കോടതിയിൽ സമ്മതിച്ചു.എന്നാൽ രാജന്റേതെന്നു കരുതുന്ന ഒന്നും തന്നെ കണ്ടെത്തി കൊടുക്കാൻ പോലീസിനായില്ല. മരണം വരെ ആ അച്ഛൻ തന്റെ മകനെ കാത്തിരുന്നു.
" ഈ കർക്കിടകത്തിൽ മഴ തകർത്തു പെയ്യുന്നു. മഴ പൊഴിയുന്ന ഈ രാത്രിയിൽ ഞാൻ അവന്റെ കാസറ്റിലാക്കിയ പാട്ട് വയ്ക്കുന്നു. ഞാൻ കേൾക്കാതെ പോയ പാട്ടുകൾ കൊണ്ട് എന്റെ ഭൂമി നിറയുകയാണ്. പുറത്ത് മഴ നനഞ്ഞ് എന്റെ മകൻ നിൽക്കുന്നു. ഞാൻ വാതിൽ അടക്കുന്നേയില്ല. പെരുമഴ എന്നിലേക്കു പെയ്തു വീഴട്ടെ. ഒരുകാലത്തും വാതിലുകൾ താഴിടാനാവാത്ത ഒരച്ഛനെ അദൃശ്യനായ എന്റെ മകനെങ്കിലും അറിയട്ടെ."

It took me a long time to write a review of Professor TV Eachara Warrier's Memories of a Father, translated from Malayalam by Neelan Premji. This was a devastating book. Nothing I have read in recent times has left me haunted like this book has. I shiver to think that an atrocity like Rajan's murder has occurred in our country (a fine democracy indeed!) and the perpetrators of the crime have just gotten away with it.
This happened sometime during the dark Emergency days (between 1975 and 1977) and although we have come a far way from then, our judicial and political systems are not very different. It is important that we read about the past, and acknowledge that such an incident occurred. I seethe with anger at the injustice of it all. These words from Professor Warrier's book are deeply poignant and I can't help but keep thinking of it:
The rain is still lashing out. I remember my son when this heavy rain drums my rooftop, as if someone is opening the locked gate and knocking at the front door. It is not right to write that a living soul has no communication with the dead.
I hear his songs from a cassette on this rainy night. I am trying to retrieve a lost wave with this tape recorder. The good earth is getting filled with songs till now unheard by me, this crude man. My son is standing outside, drenched in rain.
I still have no answer to the question of whether or not I feel vengeance. But I leave a question to the world: why are you making my innocent child stand in the rain even after his death?
I don't close the door. Let the rain lash inside and drench me. Let at least my invisible son know that his father never shut the door.'
History will never forgive us if we forget this father's tears.

ഈ പുസ്തകം വായിച്ചാൽ കരഞ്ഞു പോകുമെന്ന് എനിക്ക് നല്ല ബോധ്യമുണ്ടായിരുന്നു. അത് കൊണ്ട് തന്നെ മനഃപൂർവം വായിക്കാതെ മാറ്റിവെച്ചു കൊണ്ടിരുന്നു ഇത്രനാൾ.
രാജൻ കേസിനെ കുറിച്ച് ഓർമ്മ വെച്ച നാൾ മുതൽ കേട്ടിട്ടുണ്ട്.. ഇപ്പോൾ പോലും എവിടെയെങ്കിലും രാജനെ കുറിച്ച് ഒരു വാർത്ത കണ്ടാലോ കേട്ടാലോ അതറിയാൻ എനിക്ക് താല്പര്യമാണ്.
50 വർഷങ്ങൾ കടന്നു പോയി.. എങ്കിലും രാജൻ ഇപ്പോഴും പലരുടെയും നെഞ്ചിലെ വിങ്ങലാണ്. അതിനു പ്രധാന കാരണം ഈച്ചരവാരിയർ എന്ന അച്ഛനും.

ജയറാം പടിക്കൽ എന്ന ദുഷ്ടനായ മൃഗം നടത്തിയ നര നായാട്ട്, പുലിക്കോടന് നാരായണന് എന്ന കേരളാ പോലീസിലെ വൃത്തികെട്ട മറ്റൊരു മൃഗത്തിന്റെ ക്രൂര ചെയ്തികൾ.. മരിച്ചു മണ്ണടിഞ്ഞാലും മായാത്ത വെറുപ്പാണ് ആ നരാധമന്മാരോട്..
രാജനെ മാത്രമല്ല കക്കയത്തെ ക്യാമ്പിൽ എത്രയോ യുവാക്കളെ കൊല്ലാകൊല ചെയ്തിരിക്കുന്നു... കാലമെത്ര മാറിയാലും ഇതൊക്കെ എങ്ങനെ മറക്കാൻ പറ്റും..!
ഈ ബുക്ക് ഈച്ചരവാരിയർ തന്റെ മകനെ കുറിച്ചുള്ള ഓർമ്മക്കുറിപ്പുകൾ എന്ന രീതിയിലാണ് എഴുതിയിരിക്കുന്നത്.. കേസിന്റെ ചില നാൾവഴികളും, കുറച്ചു അനുഭവങ്ങളും ഉൾപ്പെടുത്തിയിട്ടുണ്ട്..
മകന് നീതി കിട്ടാൻ വേണ്ടി അലഞ്ഞു നടന്ന് ഒടുവിൽ തോറ്റു പിന്മാറി തീരാ ദുഖമനുഭവിച്ചാണ് ആ മനുഷ്യൻ ഈ ഭൂമി വിട്ടത്.. ആ അച്ഛന്റെ 'കുഞ്ഞിമോനെ' എന്ന വിളിച്ചുള്ള ഓർമ്മകൾ വായിച്ചാൽ മനസാക്ഷിയുള്ള ഒരു മനുഷ്യനും കണ്ണു നിറയാതെ ബുക്ക് മടക്കി വെക്കാൻ സാധിക്കില്ല..

This book, beyond being a historical recollection of Kerala's political state, it's a gut wrenching, heart breaking account of a father who lost his son. It is the search of a father who lost his son- his search for justice, for answers, and maybe, for closure.

1975-1977 അടിയന്തരാവസ്ഥക്കാലത്ത് പോലീസ് കസ്റ്റഡിയിലെടുത്ത മകന്റെ തിരോധാനം അന്വേഷിച്ചിറങ്ങുന്ന ഈച്ചരവാര്യർ എന്ന നിസ്സഹായനായ പിതാവിന്റെ ഹൃദയസ്പർശിയായ ഓർമ്മക്കുറിപ്പുകളാണ് ഈ കൃതി.ജീവന് സംരക്ഷണം നൽകേണ്ടവർ അധികാരത്തിന്റ അന്ധതയിൽ എതിരാളിയായി മാറി ജീവൻ അപഹരിക്കുമ്പോൾ നീതിക്ക് വേണ്ടി ഒരച്ഛൻ നടത്തിയ അശ്രാന്ത പരിശ്രമത്തിന്റെ വേദനാജനകമായ അനുഭവസാക്ഷ്യം.അദ്ദേഹം അനുഭവിച്ച പീഡയിലും അനിശ്ചിത്തത്തിലും വൈകാരികമായി മുഴുകി ഭാരിച്ച നെഞ്ചും നിറ കണ്ണുകളുമായിട്ടാണ് ഇത് വായിച്ചു തീർത്തത്.ഇനി ഒരിക്കലും തിരികെ വരാത്ത മകനെ കാത്തിരുന്ന ഒരു അച്ചന്റെ സ്ഥായിയായ സ്നേഹത്തിന് മുൻപിൽ ആദരാഞ്ജലികൾ അർപ്പിക്കുക മാത്രമല്ല,അനിയന്ത്രിതമായ അധികാരത്തിനു മുൻപിൽ നീതിയുടെ ദുർബലത ഓർമപ്പെടുത്തുകയും ചെയ്യുന്നു.

Before I started reading the book, I had absolutely no idea what effect the national emergency from 1975-77 had on Kerala.
I read the English translated version of the book & was kind of appalled by the state of affairs back then & in the years successive to that. This is a story of someone who fought the system at a time when there were minimal means for the same, all this because the disappearance of his son haunted him. His fight for justice is definitely worth reading/ knowing about!

A true incidence. During the Emergency time an innocent student Rajan was arrested and brutally beaten to death. No exact details were given regarding this by the Government to anyone including his father. He fought for many years and finally strictly through judicial means he got???? justice???
In this book that father Prof T V Eachara Varier explains all this. No one cant read it without shedding a tear.

This book throws it in our face.
It's a very simple book - a light read but leaves a deep impression.
A father's plight situation is expressed in simple words.
This book clears many mysteries surrounding the Rajan murder (that's what I would like to call it, cold-blooded murder). The political apathy towards the innocent is very much on display.
This book is a reminder on how things can turn ugly, very fast.
This book throws it in our face.

The book narrates a man missing incident that happened in the hours after the emergency was declared in India in 1975. The book is a very short read, but you will have to struggle with the knife of a father's grief twisting inside you as you flip through the pages.

സമീപകാലങ്ങളിൽ പത്ര മാധ്യമരംഗങ്ങളിൽ വളരെയധികം കേട്ട പേരാണ് UAPA, എന്നാൽ അടിയന്തരാവസ്ഥ കാലത്ത് MISA (മെയിന്റനൻസ് ഓഫ് ഇന്റേണൽ സെക്യൂരിറ്റി ആക്ട്) ആയിരുന്നു നിലവിലുണ്ടായിരുന്നത്. ഈ നിയമത്തിന്റെ പിൻബലത്തിൽ ആ കാലഘട്ടത്തിൽ സംശയം തോന്നിയവരെ ഒക്കെ പോലീസ് കസ്റ്റഡിയിൽ എടുക്കുകയും അറസ്റ്റ് രേഖപ്പെടുത്താതെ ദിവസങ്ങളോളം കക്കയം ക്യാമ്പിൽ ഇട്ട് ഉരുട്ടുകയും ചെയ്തിട്ടുണ്ട്. ഈ കൂട്ടത്തിൽ തന്നെയായിരുന്നു രാജന്റെയും മരണം എന്നാണ് ഇതുവരെയും പുറംലോകം വിശ്വസിക്കുന്നതും.
ഭരണകക്ഷിയിലും പ്രതിപക്ഷത്തും നിരവധി സുഹൃത്തുക്കൾ ഉണ്ടായിരുന്ന ഒരു മനുഷ്യനായിരുന്നു പ്രൊഫസർ ഈച്ചര വാര്യർ. മകനെ പോലിസ് പിടിച്ചുകൊണ്ടു പോയി എന്ന വിവരം REC പ്രിൻസിപ്പൽ പ്രൊഫ. ബഹാവുദ്ധീൻ അറിയിച്ചതിൻ പ്രകാരം അദ്ദേഹം ശിഷ്യനായ സുരേന്ദ്രന്റെയും വെണ്ണല സ്വദേശിയും ആഭ്യന്തരമന്ത്രിയും ആയിരുന്ന കെ കരുണാകരനെ അടുത്തറിയാവുന്ന ആളുമായ ഒരു പ്രൊഫസറിനെയും കൂടെ കൂട്ടി അന്ന് കരുണാകരൻ പാർത്തിരുന്ന മൻമോഹൻ ബംഗ്ലാവിൽ പോയി. ആ ഭാഗത്തായി അദ്ദേഹം കുറിക്കുന്ന ഒരു വാചകം ഉണ്ട് "എന്നെ കണ്ടപ്പോൾ ആ മുഖത്തെ ചിരി ഒന്നും മങ്ങി, ഒക്കെ എന്റെ തോന്നലാകും എന്ന് ഞാൻ ആശ്വസിച്ചു."
കോളേജ് ആർട്ട്സ് ക്ലബ് സെക്രട്ടറിയായിരുന്ന രാജൻ അന്നത്തെ മുഖ്യമന്ത്രി ആയിരുന്ന കെ കരുണാകരനെ നോക്കിയൊരു ഗാനം പാടിയതിന്റെ പേരിൽ, ആ രാത്രി ആ യുവാവിനെ കോളേജ് ഹോസ്റ്റലിൽ നിന്നും ബലമായി പിടിച്ചു കൊണ്ട് പോകുകയും പിന്നീട് അയാൾ എവിടേക്കെന്നില്ലാതെ മറഞ്ഞു പോകുകയും ചെയ്യുകയാണുണ്ടായത്.

But this book.. Its different.. Its devastating. This is the heart breaking memories of a father who lost his son. Its the search of justice, its the search of truth, its the search of his own son. Its the fight of a father against the Kerala government for his son.
During the National emergency (1976) Rajan was forcefully picked up by the Police along with some other students for a crime which he had no role and it was easily verifiable. They were randomly picking the young men whom they thought to be naxalites or naxal supporters. He was taken to the notorious Kakkayam Police camp and was brutally tortured to death. His body was disposed and not discovered till date.
Rajan missing case was the very first Habeas Corpus writ filed after the National emergency in India . It attracted the whole country’s media attention. The police have made lots of contravening statements since the father filed the case. They denied his arrest, they said he escaped from the custody etc. After the emergency, finally in the court the police admitted Rajan’s death. But the ‘predators’ gotten away nicely and continued in the top positions in the department and Kerala politics.
Prof Eechara Varier was waiting with the ray of hope until his last breath for the return of his son.
Did he really get justice.? He did fight for it, by himself. When everyone else, including his neighbours thought Rajan was a naxal and avoided him and his family, he was sad, he was scared.. But he didn’t stop. He fought for justice against the people who are in the position to serve justice.
This happened during the dark days of #nationalemergency , its creepy to think we are still not that different. But, its important to read about the past. What happened in our own place. How the justice served. Justice! Who gets justice.?

ഓർമ്മകളിൽ നിഴലും നിലവുമായി രാജൻ വരികയാണ് ,രാജനെ കുറിച്ചറിയാത്ത മലയാളികൾ ഉണ്ടാവുമെന്ന് എനിക്ക് തോന്നുന്നില്ല .മകൻ മരിച്ചാൽ അച്ഛനോ ,അച്ഛൻ മരിച്ചാൽ മകനോ കൂടുതൽ ദുഃഖം അതൊരു ഉത്തരമില്ലാചോദ്യമാണ്.. ഈച്ചരവാര്യരുടെ ലോകം രാജനായിരുന്നു. ആ സൂര്യനും നക്ഷത്രങ്ങളും അണഞ്ഞിരിക്കുന്നു . മകനുവേണ്ടി ,അവന്റെ ദീപ്തമായ ഓർമകളിൽ നനഞ്ഞുകൊണ്ട് ഒരച്ഛൻ കരയുന്നു ,രാജനെ ഏതോ കൊടുങ്കാട്ടിലിട്ട് പഞ്ചസാരയിട്ട് കത്തിച്ചു എന്നാണ് അറിവ് ,ആർക്കും അവന്റെ ഒരു കഷ്ണം എല്ലുപോലും കിട്ടരുത് എന്നായിരുന്നത്രെ നിശ്ചയം !!!

Till i read this book i was one among who wished for another emergency to have our governing system function fast and effectively.Since childhood i heard about "Rajan case "-Emergency-politicians -some police officers ,but didn't have a clear understanding of the truth.When Echara varier was dead only ,i had some curiosity on the importance of his fight for justice rather search of a father for his son.Today morning i got this book in my hands and i completed it in a single stretch (once we start reading it we cant keep the book off without completing ).
It is really sad to read the happenings in those days especially with Rajan and more is the sadness on the question
Which is denser—the pain of the son
at the death of his father or the pain of the father at the death of his son?
And now both son and father , no more and still the mystery of the remains of son is a question?

Prof. Eachara Varier tells a heartaching story of his fight for finding out what happened to his beloved son, Mr. Rajan, and also his fight for justice for his brutally murdered son, after knowing about his death. He also tells a brief account of inhumane cruelties done during the period of Emergency and the indifferent attitude of various politicians after coming to power. One cannot read through this book without a silent prayer that let there no be any more Rajans who fall victim to such brutalities.
