Without lawsuits, Structured Negotiation has led to settlement agreements with Bank of America, Walmart, CVS, Major League Baseball, Anthem, Weight Watchers, and a host of other organizations. Settlements with the City and County of San Francisco, Houston's Metropolitan Transit Authority, and Massachusetts General Hospital demonstrate the process is also a viable litigation alternative for disputes in the non-profit and public sector.
Lawsuits play an important role in moving society forward. But the legal profession — and the public it serves — deserve less costly, less stressful, and more cooperative alternatives. Clients need a forum where stories matter and they can feel heard. Would-be defendants need a process that allows them to do the right thing without having to first prove there is no problem to begin with.
While not for everyone, this is a great book about alternatives to lawsuits to settle disputes. The author’s focus is using this technique to improve access for people with disabilities in many aspects of life. Lainey has used this technique over the past 20+ years to resolve many disability rights disputes. As an accessibility specialist, I found the book enlightening. Structured negotiation helps eliminate the adversarial nature of a lawsuit and presents the “claimants” as people who just want to live their lives like everyone else - with full access and safety.
Don’t be put off that this is a “legal” book. It is very readable and understandable to all. I am friends with Lainey and am always in awe of her ability to present complex matters in an understandable format.
This is a seminal book on the practice invented by Lainey Feingold called Structured Negotiation. It is a refreshing book that will particularly please lawyers who hate practicing law the old way. I'm not a lawyer and yet know a half dozen who feel this way and are in other professions as a result. They should read this book and realize they can find a specialty where there's another way.
Lainey has changed the world of accessibility for the better. I learned a lot reading this book and heartily recommend it.
