In this book, Wolfgang Kaleck, an internationally active human rights and criminal lawyer, assesses the practice of international criminal law to date and analyses one of its main International criminal justice purports to be universal, but in reality it often operates in a politically selective manner. Until now, hardly any of those most responsible for international crimes committed by Western states have faced trial. Against the backdrop of this criticism, the book advocates a truly universal practice of international criminal law which holds even the most powerful accountable for crimes they have committed. Kaleck also tells the stories of survivors of human rights violations and human rights organizations that struggle for universal accountability for international crimes. He argues that the proponents of universal criminal justice must actively address existing double standards, as "it will not be possible to speak of a universal criminal justice system with equal rights and access to justice for all until the instigators and organizers of Guantánamo and of the atrocities in Chechnya are held accountable for their actions".

Wolfgang Kalecks Mit zweierlei Maß ist eine präzise juristische und moralische Bestandsaufnahme, die das zentrale Paradox des modernen Völkerstrafrechts freilegt. Als einer der profiliertesten Menschenrechtsanwälte unserer Zeit beschreibt Kaleck nicht nur Normen, sondern die Erosion eines Versprechens: dass vor dem Gesetz alle gleich sind – vom Warlord bis zum Präsidenten einer Großmacht.
Sein Buch ist eine eindringliche Warnung vor selektiver Gerechtigkeit. Mit historischer Schärfe zeigt er, wie das Erbe von Nürnberg im Kalten Krieg blockiert wurde und sich bis heute in asymmetrischer Strafverfolgung fortsetzt. Das Völkerstrafrecht erscheint dabei allzu oft als Instrument, das dort greift, wo Machtinteressen nicht berührt werden.
Besonders deutlich wird dies in der Analyse westlicher Straflosigkeit – von Algerien bis Vietnam. Hier legt Kaleck die blinden Flecken einer Ordnung offen, die universell sein will, aber partikular angewandt wird.
Damit liefert er ein notwendiges Korrektiv zu einer Selbstsicht, die Menschenrechte gern einfordert, aber seltener auf sich selbst anwendet. Seine Pointe ist so einfach wie radikal: Ein Recht, das nur die Schwachen bindet, ist kein Recht, sondern Privileg.
Wer dieses Buch liest, erkennt: Gerechtigkeit ist unteilbar – oder sie verliert ihren Anspruch.
