Gli impuniti: I crimini in Siria e la mia lotta per la verità

«Non ho mai visto un conflitto così feroce, con tanti bambini torturati e uccisi.» Con parole accorate e indignate Carla Del Ponte si è dimessa, dopo cinque anni di lavoro, dalla commissione delle Nazioni Unite che indagava sulle violazioni dei diritti umani in Siria. Le prove degli eccidi commessi da Assad e dai suoi oppositori ci sono, sono state accumulate attraverso foto, immagini satellitari, rapporti medici; interrogando i profughi fuggiti in Iraq, Turchia, Giordania, Libano e gli operatori umanitari incontrati nelle zone di frontiera, perché l'accesso diretto al Paese è vietato. Ma per arrivare a istituire un tribunale occorre una volontà politica. Invece gli organismi internazionali distolgono lo sguardo e l'ONU è impotente. Di fronte al fallimento della missione, la combattiva magistrata che ha portato alla sbarra l'ex presidente serbo Milošević ha scelto la denuncia: della debolezza delle organizzazioni intergovernative, degli interessi strategici che bloccano i negoziati di pace, della disperata situazione delle vittime. In questo libro, Carla Del Ponte ha raccolto le strazianti testimonianze sulle torture subite dalla popolazione, attaccata ugualmente dal regime come dai ribelli e dai terroristi dell'ISIS. Ha raccontato, con parole asciutte e inflessibili, gli attacchi dell'artiglieria contro gli ospedali, i bambini addestrati a uccidere, le ragazze vendute come schiave che si impiccano con i loro veli. Un orrore quotidiano che non deve, secondo l'autrice, restare materia inerte nelle asettiche relazioni di osservatori e commissari. Se non è possibile, almeno per ora, incriminare i colpevoli e fare giustizia, almeno si rompa il silenzio.

Carla Del Ponte (born February 9, 1947 in Bignasco, Canton Ticino) is a Swiss lawyer and diplomat. From 1994 to 1998 she was Attorney General of the Swiss Confederation. From 1999 to 2007 she was chief prosecutor at the International Criminal Tribunal for the former Yugoslavia in The Hague and parallel from 1999 to 2003 chief prosecutor at the International Criminal Tribunal for Rwanda in Arusha. From 2008 to 2011 she was Swiss Ambassador to Argentina.

From 2011 to 2017 she was a member of a commission (IICISyria) set up by the UN High Commissioner for Human Rights to investigate human rights violations in Syria in the civil war there.

Es kann wohl nur jemandem des Kalibers einer Carla Del Ponte gelingen, eine solch kompromisslose und niederschmetternde Anklageschrift im Namen der Menschenrechte zu verfassen. Sechs Jahre lang untersuchte und dokumentierte sie als Mitglied der Independent International Commission of Inquiry on the Syrian Arab Republic, welche vom UNHCHR ins Leben gerufen worden war, Menschenrechtsverletzungen im Syrienkonflikt. Stets stiess die Kommission innerhalb der UN, dem UNHCR, und dem UN-Sicherheitsrat auf taube, oder zumindest passive, Ohren - die internationale Gemeinschaft blockierte sich bezüglich einer humanitären Intervention gegenseitig. Nachdem die Kommission einschlägiges Beweismaterial für über 25 Giftgasangriffe (Sarin) beider Seiten sichern konnte, und der UNHCR weiterhin von einer offiziellen Anklage gegen die Kriegsparteien absah, platze Del Ponte der Kragen - und trat als Protest gegen die Untätigkeit von ihrer Verantwortung zurück.

Das Buch ist einerseits eine realpolitische Abrechnung mit der Untätigkeit der internationalen Gemeinschaft im Falle Syriens und der Machtstrukturen innerhalb der UN, andererseits jedoch auch eine unfassbar wertvolle Dokumentation der Gräuel in Syrien zwischen 2011 und 2017. Beispielsweise spricht Del Ponte von einer Liste mit über hundert Kriegsverbrechern, welche von der Kommission zusammengetragen wurde - und bis heute von einem Zugriff der Öffentlichkeit geschützt wird.

Del Ponte hat sich als Anklägerin im Namen der Menschenrechte nicht viele Freunde gemacht. Ihr gilt mein grösster Respekt und ich hoffe, sie sonnt sich trotz dieser frustrierenden Ergebnisse in der warmen Sonne des Tessins - ohne schlechtes Gewissen, versteht sich; denn wer, wenn nicht Carla Del Ponte, hätte ihren Job besser gemacht? Pflichtstoff.

Oft einfach eine Auflistung von Kriegsverbrechen (hätte das Buch eine Triggerwarnung, wäre es doppelt so lang). Das letzte Kapitel, wo Carla del Ponte Persönliches einfliessen lässt ist das beste. Die Bewertung ist für das Buch, nicht für Carla del Pontes Arbeit.
Ansonsten macht mich das Buch froh, dass ich
1. Nicht für die UNO arbeiten muss
2. Nicht mit Carla del Ponte zusammenarbeiten muss

The book recounts the former prosecutor's work for the UN Syria investigation. It gives insightful and nuanced accounts of the horrors perpetuated during the war in Syria on all sides involved with the conflict (governmental forces, rebels and IS fighters), but also reads a bit like a list of personal critiques, even as she describes the atrocities of torture and the situations of civilian victims and refugees. While it hints at the inner workings and the role of politics in the decisions (or non-decisions) of the UN, I would have liked to know much more about this part of Del Ponte's work. Still, an insightful read for anyone interested in trying to better understand the war in Syria.
