This book is nothing new to anyone who paid any attention to US foreign policy over the past decades. USA is the biggest bully on the block that has the decency to give sanctimonious sermons to its victims. Many people are ignorant of it, but Frédéric Pierucci did a great job exposing it on many levels.
The bully could and SHOULD be fought - strong EU, strong China, strong Russia could fight US dominance quite successfully.

Excellent témoignage de première main qui illustre bien l'aveuglement des gouvernements européens à l'encontre de la machine de guerre économique américaine qui rassemble les moyens de renseignement et de justice de la première puissance mondiale au service des corporations. Au delà du scandale du dépeçage d'Alstom, il est édifiant de découvrir les pratiques staliniennes des tribunaux américains où la vérité n'a aucune importance, où un système à charge pousse les poursuivis à admettre culpabilité là où il n'en existe pas... Récit courageux quoique par moment certes très patriotique mais encore une fois à raison !

看完之後只能說，這是本作者的抱怨書，順便幫讀者科普一下美國是如何協助國內企業打擊對手的。由於抱怨的部分佔了很大部分，因此讀來很枯燥，值得一讀的是關於後半部阿爾斯通如何被併購並隨之瓦解的部分，算是給讀者上了一課。書裡很多部分看起來真的很荒謬，不過這就是商界殘酷的現實吧。除非對這個主題很有興趣，不然類似的書應該有不少，無須特地閱讀。3/5

Excellent livre. J’ai souvent été confrontée aux règles de la compliance et de la Fcpa. Tout ce qui est décrit dans ce livre est vrai et il serait bien temps que l’Europe se doté d’ un environnement législatif pour empêcher les dégâts des intrusions économiques et juridiques américaines en Europe.

Frédéric Pierucci au moment des faits est un cadre supérieur – ou cadre dirigeant – de la société Alstom. Lors d’un voyage d’affaires aux États-Unis il est arrêté dès son arrivée à l’aéroport. Son crime ? Avoir suivi à la lettre les procédures en vigueur dans son entreprise (compliance) pour obtenir un gros contrat[1]. Cette arrestation marque le début d’une affaire qui atteindra les plus hauts sommets de l’état. Le récit que Pierucci fait de son calvaire ressemble à un livre de Kafka, sauf qu’ici nous sommes dans la réalité.
On se demande comment un tel acharnement est possible. Et puis, tout doucement et comme le cadre supérieur déchu, on commence à comprendre. Ce livre est à la fois le récit écrit à la première personne par celui qui a vécu les évènements et une enquête de journaliste menée par son coauteur, Matthieu Aron. Le résultat est édifiant – et même très étonnant – il permet de comprendre grâce à ce cas d’école on ne peut plus clair comment agissent les États-Unis dans la guerre commerciale qu’ils mènent contre le monde entier – surtout contre l’Europe car nous faisons figure de gentils comparés à d’autres pays.
On y croise aussi beaucoup de personnages qui se trouvaient, et se trouvent encore pour certains, au sommet de l’état. Voici donc avec quoi Marine Le Pen a tenté – bien maladroitement et manifestement sans aucune connaissance ni préparation – de déstabiliser Emmanuel Macron lors du débat de l’entre-deux-tours – elle n’avait certainement pas lu ce livre.

Macron a renoncé à exercer le droit de véto de l’État (qui lui aurait permis de bloquer cet investissement étranger en France). Un dispositif pourtant obtenu de haute lutte par son prédécesseur [Arnaud Montebourg]. Quelques semaines plus tard, il s’opposera pourtant à la vente de la pépite française de vidéos en ligne Dailymotion […]. Le moins que l’on puisse dire c’est que nous n’avons pas la même vision des entreprises stratégiques !

J'ai fini le livre assez vite, même trop vite car j'ai survolé les derniers 15 pour cent. Indéniablement, la tragédie humaine et le cauchemar qu'ont vécu l'auteur et sa famille font peur, nous rappelant que personne n'est à l'abri de l'œil du Grand Frère. J'ai pourtant quelques réserves par rapport à la manière dont les faits ont été exposés.
D'abord, le livre ressemble beaucoup trop à une plainte pour être considéré comme une investigation sérieuse. L'auteur ne cesse de répéter les même arguments d'un ton réverbatifs, allant parfois jusqu'à des constructions logiques inutilement complexes. D'une manière plus générale, je trouve qu'on n'a pas laissé le texte maturer quelques semaines de plus ; clairement, l'auteur s'est précipité de publier son histoire sans prendre de recul necaissaire pour peaufiner son travail.
Enfin, l'auteur a quand-même donné des pots-de-vins ! Son explication était que tout le monde le faisait à l'époque... Alors, n'a-t-il pas essayé de justifier son manque de considération des risques professionnels à l'aide de ce process accusatoire contre Alstom, sous forme de livre ? Enfin, donner des pots-de-vins, ce n'est pas bon, tout le monde le sait...
Je souhaite que plus de gens soient conscients des dangers du système des lois extraterritoriales américaines, mais j'ai peur que cet ouvrage rende la cooptation difficile.

Fort intéressant. Une fois de plus une vision très française des US. L’application du FCPA aux compagnies européennes n’est pas un piège mais une tentative de mettre fin aux pratiques des sociétés européennes qui ont institutionalisé la corruption avec l’assentiment de leur gouvernement. Alsthom n’a eu que ce qu’ils méritaient. Le traitement de Pierucci est indéfendable mais il a été pris dans le tir croisé. Il a toutefois été très naïf de laisser son nom sur des courriers qui l’incriminaient alors qu’il était en poste aux Etats-Unis.

Une histoire vraie qui se lit comme un roman. Difficile de ne pas s’identifier avec le héros malgré lui de cette incroyable affaire. C’est aussi une histoire très crue du monde des affaires et des réflexes prédateurs des États Unis. Ça fait peur. Je ne veux pas non plus oublier l’incroyable cynisme de certains de nos élites françaises. Cocktail explosif qui se lit d’un souffle. J’ai adoré.

This book uncovers the backstory behind the 2015 General Electric acquisition of the French company Alstom. It is written by Frédéric Pierucci, a former senior manager at Alstom. In this book, Mr. Peirucci detailed his own experiences of being arrested and detained by the US government. Subsequently, Mr. Pierucci was used as an economic hostage to force the former CEO of Alstom into selling Alstom to its biggest competitor, General Electric.
The allegations in this book are explosive. However, for those who know a bit about American government's foreign policies, this sort of thing is not new. This book spends a lot of times on America's Anti Corruption Foreign Law (FCPA) which allow the USA to manipulate and control foreign corporations. Basically, this law empowers the US government to detain and arrest the citizens of any country, at anywhere in the world, and extradited to America for trial, if they are implicated in corruption or bribery and used anything related to America (such as using an American mail, sent emails that went through servers in America, or if your contract is negotiated in US dollars). On papers, this law sounds moral and righteous. But according to the research in this book, it is an open secret that the American government practices double standard in the law's executions. i.e. since the law was birthed 40 years ago, more than 80% of companies fined by this law were European. Meanwhile the large US corporations, including the US weapon companies in the notorious military industrial complex, were rarely prosecuted for corruption (even if the US enterprises are found guilty, the fines are usually light).
This book explores how the US government weaponize this FCPA to helping American corporations to wipe out its foreign competitors. If you work in a non-American, multinational company, and your company is a big competitor to an American enterprise, then you should pay special attentions to chapter 22 of this book. Yep, if the company you work is non-American and it is a competitor to an American company, then next time your company gives you anti-bribery trainings, make sure you hardcode the anti-bribery precautions into your brain, and never take shortcuts at work. Protect yourself, if something feels wrong then don't do it, lest you end up like Mr. Pierucci. Seriously, if you can only remember one take away from this book, then it should be the FCPA.
This book is unputtdownable. The pace is fast. It is as much as about Mr. Pierucci's own experiences as it is about America's imperialistic practices. Once I open the book, I couldn't stop reading it until the very last chapter.
What really astonished me is how the French government acquiesced to this type of daylight robbery and letting a French citizen take the fall for someone else's wrongdoings. According to Mr. Pierucci, a lot of French people know the truth behind the acquisition but they could only watch on helplessly while the "pearl" of the French industry was (arguably) forced sold to an American company. In many ways I can sympathize with the French. This is because as a Taiwanese, we are currently watching helplessly as America is forcing Taiwan's pride and joy, the Taiwanese Semiconductor Manufacturing Company (TSMC) into relocating to America, and effectively turning it into "ASMC". We all know that America has lost its own ability to manufacture semiconductor chips, and so now they are forcing TSCM to become effectively ASMC, to make up for their own shortfalls. Just two weeks ago, the news in Taiwan reported the American government used 7 airliners to take all TSMC researchers and engineers from Taiwan to America. It is effectively, emptying TSMC's R&D capability and forcefully transplant the company from Taiwan to America. Sadly, the government of Taiwan is not stopping this daylight robbery and instead they are aiding the American government, because the Taiwanese government is essentially, a vassal of the USA.
It does sound very bleak but the reality is the American government, with its military power, USD hegemony, and its superior intelligence and surveillance capability, can bully any country and annex any foreign corporations. However, just days ago, the US judge dismissed indictments against the Huawei CFO. Perhaps this news can bring comfort to Mr. Pierucci, because it shows the American government doesn't always succeed in its imperialistic agendas. Meanwhile, if you are an aspiring company or a country in the global south, then this books is a cautionary tale you cannot afford to miss. After all, if the American government can do this sort of things to its supposed "ally", what do you think the American government will do to you, a company or a country in the global south, should you thrive and become a major competitor to the US one day?

US Extraterritorality is a clear loss of sovereignty for foreign nations whom have been victim of the unfortunate faith to fall under. This book illustrates perfectly, the damages on a person (the author), a company (alstom) and a nation (France) that the weaponization of the FCPA led by the States and DOJ. Lawfare and broader context of economic warfare are predatory actions where Uncle Sam excels at. Really good testimony and deserve to be read and shared.

This book is the story of a Frenchman caught and imprisoned by the US in 2013 for bribery and corruption 10 years ago while employed by a French conglomerate Alston while it was successfully bidding to win a government contract to build a power plant in Sumatra, Indonesia.
The writing style is easy to read, and the story flows seamlessly. The writing keeps the reader interested because not only it illuminates the way the US justice and incarceration system works, but also adds along the way riveting stories of fellow inmates and how they get along living together in a tiny cell of 13 square yards.
Each chapter is kept very short, making the book very easy to read.
The book reveals a lot of what happens within the US system of justice, how almost all indictments end with a guilty plea in return for reduced sentences and spilling the beans on the big cats.
The second half of the book becomes dry and boring as it is mired in excessive detail in the dirty politics behind the top echelons of power at Alstom which in collusion with General Electric and the US Dept of Justice, sacrificed the interests of the French company and the national security of France, in order to protect themselves from arrest and prosecution.
Nevertheless, it is an illuminating real life look into how the US, which has the world’s biggest spy network, uses the FCPA (Foreign Corrupt Practice Act) in order to trap foreign multi nationals into paying billions of dollars in fines and in some instances, takeover targets for American companies.
4 stars because of the importance of the message, otherwise I would give it 3 stars.

Le Piège américain de Frédéric Pierucci et Matthieu Aron offre un aperçu captivant et éducatif des stratégies économiques agressives de l’administration américaine envers les entreprises étrangères, notamment leurs rivaux directs, dans divers domaines. L'histoire de Pierucci, ancien cadre chez Alstom, plonge le lecteur dans un récit authentique et percutant, révélant comment la justice américaine a été utilisée pour des intérêts économiques.
Ce qui rend ce livre si intéressant, c'est le récit personnel de Pierucci sur sa détention en prison. En décrivant ses journées et nuits derrière les barreaux au Wyatt et au Moshannon Valley Correctional Center, le lecteur ressent presque sa présence, submergé dans ce monde étouffant. Chaque aspect est décrit en détail : les injustices criantes, le comportement manipulateur des gardiens, l'indifférence des travailleurs sociaux et la tension issue des lois non-écrites des détenus. Pour ceux désireux de comprendre les coulisses de cette lutte silencieuse et les tactiques d'intimidation visant à affaiblir les géants européens, cette lecture s'avère indispensable. Personnellement, j'ai été fasciné, marqué, et je ne peux que vous le recommander vivement.

Sad and true story but extremely biased perspective
I find it surprising that the author was not aware of FCPA and its implications and while it sheds light on a lot of problems regarding the justice system of the US, it provides a very biased perspective. The biggest problem in all the challenges Frederic Pierucci went through was the CEO of Alstom, having a bad lawyer, and the lack of support from the French government, and yet I think due to his (justified) anger, he presents a perspective with some missing pieces. I also think the problems associated with the justice system are systematic problems that the US needs to address, but unfortunately, many countries, including France, have different problems with their justice system. This is not to defend what happened to the author but to put things in perspective.
In addition, the book reads more like a memoir rather than a structured book regarding "America's economic war," with way too many details regarding his prison days.
I think the book is worth only a quick read because of all the buzz around the subject and the book, but there were way too many details regarding his time in the prison and the arguments regarding his claims are not well structured. I honestly think he was able to ride the wave of "Anti-Americanism" but the book lacks real substance...

Le piège Américain est un témoignage. Le témoignage d'un homme abandonné à son sort par son entreprise, une des plus belles du pays, entreprise qui sera vendue à la découpe par son dirigeant, avec un seul objectif pour celui ci : sauver sa peau. En s'en mettant plein les poches au passage pendant que son ancien cadre salarié croupit dans les geôles US. Frédéric Pierucci se qualifie à juste titre d'otage économique et révèle dans ce livre un scandale d'état incroyable.
Tout cela en lien direct avec les lois "extraterritoriales" des États Unis, comble de l'ignominie hypocrite de ce pays soi-disant vertueux (alors que son système judiciaire et carcéral est indigne de celui d'une nation civilisée), et la corruption (au moins dans les esprits) d'une grande partie de la classe politique Française.
Le livre est passionnant, édifiant, terrifiant.
Avec des alliés comme les États Unis, la France n'a pas besoin d'ennemis.
Tout cela en lien direct avec les lois "extraterritoriales" des États Unis, comble de l'ignominie hypocrite de ce pays soi-disant vertueux (alors que son système judiciaire et carcéral est indigne de celui d'une nation civilisée), et la corruption (au moins dans les esprits) d'une grande partie de la classe politique Française.
Le livre est passionnant, édifiant, terrifiant.

The world is predictably numb to all these, subconciously or chose to subconciously ignore all these and succumb to the dark secret of the American power.
Thank you for putting all these together, in such a precise, concise, logical, and "interesting" way. It's a joy to read your book, and yet between the lines, I could feel the excruciating pain. It takes so much, courage, endurance, perseverance, and a lot more, to be able to put all this down. Fearing the FBI would be after you and your family all the time, even at this moment. But now we have the world watching you. Out of so many, you are the only one standing up to let the world know.
