“Wilder, an indigent, was walking through Central Park when he decided to rob someone. He hid behind a tree, lying in wait for a victim to approach. Shortly thereafter, Jody, a 16-year-old girl, was strolling in the park when Wilder suddenly jumped from his hiding place and accosted her. Although Wilder intended only to rob his victim, he punched her in the mouth, and she fell to the ground. Wilder then grabbed her pocketbook and fled. Unknown to Wilder, Jody suffered a fractured skull when her head struck the pavement. She subsequently died from her head injuries.”
