Here's a recent interview with Andrew Scott who plays Moriarty, asked about him returning in Season 3, possibly as Moriarty's brother.

I don't know - I think it wouldn't be the same without him. I mean really.

Sometimes i think they shouldn't have introduced him in the first six or at least first three episodes at all. just made awesome episodes.
but then....oh well!

I think he played Moriarty devilishly well. He appears to be the most crazed tv villian yet, and a worthy opponent for Sherlock and Watson. Can't imagine him not returning. and of course you know that Irene Adler and Moriarty are going to have to team up at some point! ;)

You gotta love Sherlocks cheeckbones - but Moriarty is a really devilishly interesting character in the bbc series
