He was definitely free in choosing to do mercy, but he had to see Lord Alban in action to realize that humans can change, maybe more easily than elves (with God's grace). It was a prejudice stemming from their psychology.
Ystevan would have never changed his mind except by seeing with his own eyes what Serapia had been telling him all along. And her relentless insistence must have planted a small seed of doubt in his mind.
