D.A. Alvin Bragg Must Be Held Accountable For Refusing to Investigate Dorothy Kilgallen’s Death

To that end, on February 7, 2025, this author sent a lengthy letter to New York County District Attorney Alvin Bragg with copies to Alvin Bragg’s Manhattan Office, Ms. Pat Bondi. U. S. Attorney General, Ms. Lettia James, New York State Attorney General, Ms. Danielle R. Sassoon, the U. S. Attorney for the Southern District of New York, and the First Judicial Department New York Attorney Grievance Committee.

The Letter reads in part:

Mr. Brag:

In the interest of justice based on allegations of impropriety amounting to dereliction of duty, I have filed a complaint with the Department of Justice, the U. S. Attorney for the Southern District of New York, the New York State Attorney General, and the New York Attorney Grievance Committee. This complaint stems from you and your office’s continuing refusal to provide media Icon Dorothy Kilgallen with a thorough investigation of her death in 1965 despite knowledge of compelling evidence that she was murdered.
Referencing your disturbing conduct is a New York Post article written by Sue Edelman, wherein your office declined to investigate Dorothy Kilgallen’s death. Queens Councilman Bob Holden, who demanded an investigation by you and the NYPD based on his own belief that Kilgallen was the victim of foul play, is quoted as stating to the Post that he “only got only lip service” when he requested an investigation.

Also included in the article were these quotes from Mr. Holden: 

“I was told there was going to be an investigation, but it turned out there wasn’t. They [DA office] just looked at it on a superficial level and decided it wasn’t worth doing.”

The concerns that many people supporting me and I have, is whether the manner in which you and your staff have handled the request for an investigation of Dorothy’s death by a respected councilman is “The fair administration of justice, without fear or favor?” and whether your declining to investigate Kilgallen’s death lives up to the motto on your website, “One standard of Justice for All?” To the contrary, it seems that your non-action is a deliberate dereliction of duty, one involving allegations of impropriety, since, according to Councilman Holden’s observation, to repeat for emphasis, your office “just looked at it [his request] on a superficial level and decided it wasn’t worth doing.”

Mr. Bragg, of great interest to you and your staff should be the accounts from the infamous forensics expert, Dr. Michael Baden, whose name is on the Kilgallen autopsy

Without question then, he should be the first person you and your staff interview. As I pointed out in my January 22nd letter to you. Among other revelations are his stating:

Regarding the timing of Kilgallen’s death, Dr. Baden admitted, “Yes, it was very convenient for a lot of people.” He agreed that she could likely have been planning to expose those involved in JFK’s assassination in the book she was writing [for Random House.]

During a February 25, 2020, phone interview with this author, Dr. Baden, who assisted Dr. James Luke with Kilgallen’s autopsy, stated that in his opinion, due to Dr. Luke’s admission’s he did not know what the cause of death really was: “What Luke said went beyond the bounds of what he should have told the media.”

Dr. Baden stated that he and Dr. Luke expected that NYPD detectives would follow through, as would be normal in what Baden called “a high-profile, VIP international case,” his “first high-profile case,” with what he dubbed a “full” investigation. He then agreed that the death scene was quite “suspicious” and that he recalled “serious discussions” with Dr. Luke and NYC chief medical examiner Dr. Milton Helpern about Kilgallen’s case.

[Note: no investigation by the NYPD occurred then or during present day.]

Others besides Dr. Baden who were there in 1965 when Dorothy died and thus primary source witnesses must be interviewed include these eyewitnesses to what happened:

Former Dutchess County Sheriff’s Deputy Dennis O’Keeffe:

I knew Detective John Doyle, known as Jack “Popeye” Doyle who, along with Detective Mike Ward, had arrived at Kilgallen’s townhouse on the day she died.
Doyle was a young detective and responded to the death of Dorothy Kilgallen and filled out the death report, a DD-5 (Detective Division – 5) form. He said it contained all of his interview notes.

[Demands by this author that the NYPD discover and then release the DD-5 document in Kilgallen’s case through the Freedom of Information avenue have been stonewalled at every turn for years on end.]

Ms. Eileen Broich – (NYC Medical Examiner’s Office Chemist John Broich’s widow; speaks to John’s work at ME office.

John admitted Mafia presence in the office. They were intimidating. He called one time from the city and was terrified. He was strong-willed. He couldn’t be bought. There was pressure to fudge results. I said, “Why don’t you go to the police?” John said, “They can’t help me.”

John said “We’ve discovered that she was most likely bumped off. That was the terminology.

My father telling my mother that Dorothy Kilgallen was bumped off, would be accurate in that the language and syntax that he used, that’s how he would describe someone getting killed.

“My mother was murdered” to a close friend who may be interviewed. She also told another friend, “My mother was ‘quieted’” [She must be interviewed as well.

Mr. Bragg, something is fishy here since with more than 50 pages of evidence from my latest book [Injustice of the First Degree] pointing to Dorothy, called by the New York Post, “the most powerful voice in America,” being the victim of a homicide included with my January 22nd letter and included here as well that point to the dereliction of duty, is that neither you, your office staff nor the NYPD have apparently even considered the new evidence. The proof is that, based on my checking with the “witnesses” I provided, not one interview of those whose shocking accounts regarding not only the fact that Kilgallen was murdered but denied any investigation at all when she died, has occurred.

Hopefully[ the authorities mentioned above], ones designed to ensure that citizens are provided the justice they deserve even though they may have passed away, will probe your actions and those of the NYPD through my complaint and discover why it appears a cover-up of Dorothy’s death continues to this day.

  After I reviewed the circumstances surrounding Kilgallen’s death, I certainly suspected Ron Pataky [Kilgallen’s love interest – connected to Mafia] of wrongdoing. It appears to me that Pataky has dirty hands regarding Kilgallen’s death.    Based on the totality of the evidence and the circumstances I knew about case, there should have been a murder investigation of Kilgallen’s death. 
  I found it  disturbing that there wasn’t an investigation conducted because the facts as set forth was like, the whole thing stunk. There should have been a homicide investigation since it was suspicious that Kilgallen was laid out and very, very orderly fashion with, uh, you know, makeup and false eyelashes and things like that, that whole thing was staged, you know, it’s like it just, it stunk. 
  If there was an indicator that the capsules had been opened, it would definitely  raise suspicions in my mind that someone was trying to conceal the fact that they were administering harmful drugs to them [Kilgallen] or, or putting them in a position where they would take them unintentionally and unknowingly.  
If there was any coverup on this whatsoever, it would’ve been down at the ME’S office. She also told another friend, “My mother was ‘quieted’” [She must be interviewed as well.   Mr. Bragg, something is fishy here since with more than 50 pages of evidence from my latest book [Injustice of the First Degree] pointing to Dorothy, called by the New York Post, “the most powerful voice in America,” being the victim of a homicide included with my January 22nd letter and included here as well that point to the dereliction of duty, is that neither you, your office staff nor the NYPD have apparently even considered the new evidence. Shame on Those Who Continue to Malign Marilyn Monroe

Not only has poor Marilyn been mentally abused in the film, “Blonde,” where the director Andrew Dominik admits “we didn’t give a damn about the truth,” but in my latest book, “Fighting for Justice,” only Dorothy Kilgallen defended Marilyn against Anthony Summers wrote in his 1985 book Goddess: The Secret Lives of Marilyn Monroe that became

the Netflix documentary The Mystery of Marilyn Monroe – The Unheard Tapes where he portrayed the legendary film star in a manner that was unjustifiably malicious, vindictive, defamatory, and downright degrading. While insisting that she committed suicide, Summers had as his agenda that pre-determined conclusion and then worked to fit an assorted set of facts to it while excluding significant evidence to the contrary. The result: An ill-advised documentary resulting in distortions of history about Marilyn’s life and times and her death excluding the fact that she was murdered in August 1962 and that RFK had the strongest motive to have orchestrated her death so as to silence her.
Adding confusion to the documentary was Summers’ comment toward the end. He told viewers: “I did not find out anything that convinced me that Marilyn had been deliberately killed.”
Why the confusion? Because Summers and director Emma Cooper actually provided some compelling evidence to the contrary from audiotaped interviews that the Kennedys, specifically Bobby were concerned with Marilyn’s potential to cause a scandal enveloping JFK and RFK. The sound bites chosen from various sources indicated they were “playing with fire,” “that we can’t deal with Marilyn anymore,” and that “she was raising a stink” during the months leading up to her death.
This said, to lead viewers away from such matters, Summers unnecessarily did everything possible to demean Marilyn including depicting her, based on interviews with unsavory sources, as a slut, a whore, crazy, a drug addict, one who used “sugar daddies” to get ahead, that she was “animal like,” “a Communist” and one who enjoyed orgies with both Kennedy brothers. In his 1985 book, Summers even included a grainy post-autopsy photo of Marilyn, disgraceful conduct for sure.
To then seal the “verdict” they were seeking, that Marilyn was suicidal, Summers and Cooper violated Marilyn’s rights to privacy by utilizing the substance of conversations she had with her psychiatrist Dr. Ralph Greenson. In the documentary, Summers admitted that Greenson’s wife Hildi “allowed [me] access to many of Dr. Greenson’s papers, his letters, which were gold dust.” Common sense dictates that Summers and Cooper must have known (most likely), or should have known, based on numerous years of research for the various editions of his book and the documentary that included a thousand interviews and discovery of numerous government documents that Hildi would not have had the right to do so unless Marilyn gave her permission. That is virtually impossible yet Summers used the “gold dust” to damage Marilyn’s persona, her reputation, in tandem with his suicide conclusion.
To confirm that only the patient can provide permission for any disclosure of conversations or notes regarding conversions Marilyn had with Dr. Greenson while she was in therapy, I interviewed noted psychiatrist Dr. Jacob Towery. He is a private practitioner who has written for The New York Times and the Washington Post as well as being Adjunct Clinical Faculty at Stanford University School of Medicine and Department of Psychiatry and Behavioral Sciences. Dr. Towery, after reviewing Summers conduct, told me,
Within the field of psychiatry, it is agreed that the standard of care is to maintain the confidentiality of our patients at all times. This extends even after a patient has died. Patients often place a great deal of trust in their psychiatrist, revealing things they may not reveal to anyone else, and it is our duty to protect that confidentiality including notes we take about a patient. If Marilyn Monroe’s psychiatry notes fell into the hands of her psychiatrist’s wife, it would not have been appropriate for her to release these notes and violate Ms. Monroe’s privacy.
Since the psychiatrist/patient privilege continues after the death of the patient, whatever Marilyn said to Greenson is confidential and any notes about those conversations privileged as well. Multiple emails sent in early May 2022 to both Summers through his book agent Olivia Edwards at Curtis Brown UK and Cooper through her website asking whether either had permission from Monroe to expose her confidential discussions with Greenson or permit his thoughts about them to be included in a book or documentary, went unanswered leading to the belief no such permission exists. The result: Marilyn’s right to privacy via the psychiatrist/patient privilege was apparently violated.
Nevertheless, in a highly unprofessional and unethical manner, Summers actually revealed many of Greenson’s conclusions regarding Marilyn’s mindset based on their privileged conversations. No explanation, no context was provided by Summers as to when and exactly what Marilyn told Greenson leading to the conclusions. This is quite unfair to her, for him to cherry pick certain opinions the psychiatrist had about Marilyn in the documentary (none are included in Summers’ book). Marilyn thus has no way to defend herself against the potentially misleading portrayal of her mental state and documentary viewers have no idea what observations Greenson may have had about Marilyn’s upbeat behavior perhaps in the days just before she died.
This said, what strong evidence did Summers and Cooper leave out of the documentary? Many examples exist but three major ones are of paramount importance.
Regarding Dorothy Kilgallen, recall that she penned one of her New York Journal American articles about Marilyn just two days before her death.

It read:

Marilyn Monroe’s health must be improving. She’s been attending select Hollywood parties and has become the talk of the town again. In California, they’re circulating a photograph of her that certainly isn’t as bare as the famous calendar, but is very interesting. And she’s cooking in the sex-appeal department, too; she’s proven vastly alluring to a handsome gentleman who is a bigger name than Joe DiMaggio was in his heyday. So, don’t write Marilyn off as finished.

To deal with Kilgallen’s sunny words about Marilyn’s mindset in the first two sentences (followed by a sure reference to RFK based on his being “a bigger name than Joe DiMaggio”), Summers took the approach, misleading for sure in the 1985 edition of Goddess by leaving out the words, “Marilyn Monroe’s health must be improving. She’s been attending select Hollywood parties and has become the talk of the town again.” In the updated paperback edition (2022), the same exclusion of Kilgallen’s first two sentences occurs at page 441 and in the documentary, no mention whatsoever is made of any part of the column. This is deception for sure since Summers had to leave part of the quote out since it doesn’t fit the mold of a woman being suicidal, one whose “health must be improving.” In fact, Kilgallen, who was aware that Marilyn had Broadway offers, a dream of hers, later wrote of suspicions she had about Marilyn’s death, stating, “the real story hasn’t been told, not by a long shot.”

A Tribute to Dorothy Kilgallen, Acclaimed Journalist, Media Icon, and Above All, a Woman of Integrity

As we ring out 2022 and ring in 2023, I am reminded of the quote from acclaimed novelist Lois McMaster Bujold: “The dead cannot cry out for justice. It is the duty of the living to do so for them.” For more than 15 years, that has been my “job.”

Since late 2016 when my bestselling book,  The Reporter Who Knew Too Much , was released on through to the publication of  Denial of Justice Collateral Damage , and most recently,  Fighting for Justice , each inspired by my muse, Dorothy Kilgallen, I have attempted to secure justice for my “friend” from the hereafter in a court of law. Despite overwhelming evidence that she did not overdose on drugs in late 1965 but instead was murdered by powerful men threatened by her exposing the truth about the JFK assassination, I have failed to obtain that justice through strong demands to governmental agencies in New York City that decided Dorothy’s case wasn’t worth their time and expense. Shame on them.

This said, only in the past few days have I realized that my determination to clear Dorothy’s name and restore her fine reputation has resulted in another “kind” of justice for this one-of-a-kind media icon, one accomplished in the court of public opinion. This revelation came about while watching a riveting Netflix documentary about another amazing, courageous woman, my longtime friend, and stellar women’s rights advocate attorney Gloria Allred. While pointing out that many of her clients who were raped by Bill Cosby could not pursue claims in court against him due to the statute of limitations, these brave women, by coming forward with their evidence, were able to secure some justice for themselves by holding the reprobate Cosby accountable for his actions.

Hearing of Gloria pursuing this “type” of justice made me realize that just as these victims’ voices were heard so has Dorothy’s concerning her own denial of justice since thousands upon thousands of people have either read my last four books or watched interviews or presentations about them on YouTube. To date, there have been more than 8 million views including nearly 600,000 for a presentation I gave on Fighting for Justice at the Commonwealth Club of San Francisco just 20 days ago.

As important as it is to learn more about Dorothy and her crusade to expose cover-ups of the truth about matters of significant historical importance through my books, a tribute to her exists based on the more than 1000 “Comments” adjoining the YouTube video. People truly admire and respect Dorothy and one comment, in particular, stands out: “If integrity had a person to represent itself, it would be through Dorothy.” Another comment is also most appreciated: “Ms. Kilgallen will get her proper recognition, thanks to this Warrior for justice, Mr. Mark Shaw.”

Regarding Dorothy’s “achievements” pointing to that recognition, (more included in Fighting for Justice) they are:

Loving mother of three young children.

At age twenty-three, a competitor against two men in the 1936 “Race around the World” restricted to commercial travel, where she became the first woman to fly across the Pacific while setting speed records. Famed aviator Amelia Earhart sent her good wishes, and First lady Eleanor Roosevelt praised this accomplishment.

During the Christmas holidays in 1937 (Kilgallen was twenty-four), a surprise announcement appeared in Hearst newspapers across the country: “The first and only Woman Columnist Dorothy Kilgallen’s Voice of Broadway Column Starts Monday. A Man’s Job. Beginning Monday in the New York Journal-American, Dorothy Kilgallen will Report Daily on the Deeds and Misdeeds of Broadway and important criminal trials. A Man’s Job. But Dorothy has been doing a Man’s Job and Doing It Better.” (Column syndicated to 200 newspapers across the country).

During World War II, hosted a radio program Dorothy Kilgallen’s Diary to raise money through the sale of War Bonds.

Nominated for a Pulitzer Prize based on coverage of Queen Elizabeth’s coronation in 1953.

From 1950 to 1965, a star panelist on the CBS program What’s My Line? viewed by more than ten million people each week.

From 1945 to 1963, co-hosted with her husband, Richard Kollmar, an NYC radio program Breakfast with Dorothy and Dick, listened to by a million people a day.

As a top-notch investigative reporter, she covered the Lindbergh Baby kidnapping case and the Dr. Sam Sheppard murder trial where she later saved him from life in prison by exposing judicial misconduct in an appeal to the Supreme Court.

Exposed evidence that her friend Marilyn Monroe did not commit suicide through a column entitled, “MM Has Hollywood Talking Again” while blaming her death on “the Kennedy’s.

Confronted singer Frank Sinatra regarding his womanizing and affiliation with the Mafia in several columns putting herself in danger.

Became the most credible journalist to have investigated the JFK assassination in history to the extent of being the only reporter of 400 who interviewed Jack Ruby at his trial and later exposed his Warren Commission testimony before its release date causing J. Edgar Hoover to become a mortal enemy.

If she had lived past the young age of 52, her intention to expose evidence pointing to the truth about the JFK assassination and corruption at the Warren Commission passed on to her by commission member Sen. John Sherman Cooper of Kennedy, a “longstanding friend” in a “tell-all” book she was writing for Random House as explained in Fighting for Justice. (Proof that Dorothy was correct about her assassination theories is that she was killed.)

Amazingly enough, all this from a college dropout who had to withstand an era of gender discrimination abounding at every turn.

As a noted historian (my body of work is being archived by my alma mater Purdue University), and an investigative reporter who has followed closely Dorothy’s research methods as explained in Fighting for Justice), I have honored her memory along the way. She was fearless and obsessed with discovering the truth based on solid research and credible, primary source accounts, unlike today when those so-called “experts” about the assassination and ones part of what I call the “extreme media” who have few morals or ethics, don’t give a damn about that truth. No wonder I have received hundreds of emails from people around the world stating, “I wish we had a reporter like Dorothy Kilgallen today.”

For certain, Dorothy is the perfect role model for young people and I am proud that she “chose” me to tell her story. Though the justice she is getting in the court of public opinion is unconventional in nature, the woman who was called “the most powerful female voice in America” lives on through her newspaper columns, the What’s My Line? re-runs, my books, and presentations about those books including a recent one that may be viewed here. She will never be forgotten.

Will President Joe Biden’s Release of the Remainder of JFK Assassination Documents Expose New Evidence in “Fighting for Justice” that Famed Journalist Dorothy Kilgallen was Murdered and by Whom?

As the clock ticks towards later today when President Joe Biden will release some, but not all of the remaining JFK assassination government documents, it is appropriate to wonder if those documents will include proof of Warren Commission (WC) corruption and new revelations that the CIA recruited Lee Harvey Oswald to be part of the plot. More importantly, will the documents reveal why and by whom famed journalist and media icon Dorothy Kilgallen was silenced in 1965 because she was indeed the “Reporter who knew too much,” the title of my bestselling book.
As readers of the new true crime murder mystery will realize, Kilgallen was in danger as the fall of 1965 approached based on her intent to expose WC corruption and her knowledge that Robert Kennedy was complicit in Marilyn Monroe’s death in a “tell-all” book she was writing for Random House but Dorothy’s potential knowledge of the CIA/Oswald recruitment, if true, adds another suspect who had motive to have her silenced, former CIA Director Allen Dulles, a member of the Warren Commission. Of Dulles, Larry Schnapf, attorney for the Mary Farrell Foundation that has sued President Biden for failure to release the remaining JFK assassination documents, told me, “Dulles was definitely installed [on the WC commission] to prevent the investigation from going in the wrong direction,” a reference to any CIA probe.
Common sense dictates that if Kilgallen knew of the CIA/Oswald recruitment, and intended to include that knowledge along with the Warren Commission corruption allegations in her book, and Dulles along with J. Edgar Hoover, who hated her for exposing Jack Ruby’s testimony before the WC before its release date, knew of that intention, she had to be eliminated. Regarding the former, Kilgallen, as proven in “Fighting for Justice,” learned of the Warren commission corruption from a member who was a “longstanding friend,” identified for the first time in the book based on an eyewitness account by his legislative assistant who told me that the member stated, among other revelations, “They [the commission members] already know about the Jack Ruby connection to organized crime, but they don’t want to touch it,” “It’s more than Oswald but Hoover and [Chief Justice] Earl Warren keep pushing the ‘Oswald Alone’ conclusion.” and “They [the commission members] say this [Oswald Alone conclusion] is good for God and the country, but there is internal corruption.”
Proof of the member’s knowledge of CIA potential involvement in JFK’s death, which he could have shared with Kilgallen causing her to be in great danger, is one of many documents hidden from public view included in “Fighting for Justice.” It reads, in part, “[Chief Justice] Earl Warren “knows all I do and more about the CIA.”
What Warren, and the commission member knew was certainly not in the commission’s final report triggering the question as to whether this document and others of an incriminating nature connected to Kilgallen being poisoned with a combination of three lethal barbiturates in 1965 will be in the new set of documents being sent later today or in the future. If they are, it is very possible that finally, after more than fifty years, this remarkable woman, this patriot, this mother of three who was above all, a journalist of integrity called by the NY Post, “the most powerful female voice in America,” will finally receive the recognition and the justice she deserves.
