Mickey didn't try to keep Jessup in jail during the trial. Was he thinking like a defense attorney or was it a realistic move?

I can see that Mickey wanted Jessup out of jail and possibly getting into trouble that they could use in the future against him at trial. But the fact is he just let out a killer. Even if they're watching him closely, there is a chance he could kill someone else before the cops had time to stop him. I didn't think it was a smart move.

This was when I knew Mickey's instincts were tooled for the defense. At a minimum, he should have fought to keep him in jail and his rolling over on this issue was just maddening.
