Turns out the case would have resulted in a mistrial because of that alternate juror. Did Mickey err in asking for the original juror be replaced, even though the odds were in his favor that an alternate favoring the prosecution would be selected (5 in 6 chances)? Was he thinking like a defense attorney or prosecutor, or could you tell?

He was playing the odds and trying to get as many jurors on his side as possible. But when you gamble like that, you sometimes lose. I can see either the defense attorney or prosecutor doing the same thing.

My thinking, too, Robin. He gambled, with great odds, and lost.
