$shared is a file hosting/sharing site, and it the functionality makes it abominably easy for copyright infringers.

However, if members of the public take the time to click the Abuse/Report button, the site takes prompt action.

One down, thousands to go....

I did not even send a DMCA. I clicked Abuse/ Other.

I suspect, even if SOPA does not pass, awareness will be raised and OSPs will become more responsive.

Good article touching on the widespread ignorance of the RED FLAG provision of the DMCA.

Whereas Alexandra appeared aware of the law, Josh appears ignorant of it.

4shared is perhaps unaware of the "red flag" provisions in the DMCA (page 53).

Under the --unfortunately-- little know provision of the DMCA, hosts can be required to remove allegedly infringing material. According to § 512(c)(1)(A)(ii), the law requires hosts to remove content where they are “aware of facts or circumstances from which infringing activity is apparent.” These are often known as “red flag” infringements.

I informed you that one of your users is posting over 1,000 e-books by well-known authors on your site. I am not one of them, but under the DMCA, I do not appear to have to be in order to raise a red flag. I provided the URL.

The test for whether an infringement raises a “red flag” or not is “whether infringing activity would have been apparent to a reasonable person operating under the same or similar circumstances.”

If you follow the link and look at the ebooks, it should be apparent and obvious that Silkworm 30 cannot possibly be 1,000 different authors, and cannot possibly be the authorized representative of multiple different publishers including ELLORAS CAVE, and cannot possibly own the copyright to 1,000 e-books.
