Child Support in Minnesota

When we were first separated I didn’t pay child support from 28JAN16 until 06MAY16. To be honest I didn’t think she deserved it, she had cheated on me so many times I lost count. Minnesota is a no fault state, meaning she is not penalized in any way for being an unfaithful wife, so yes, I didn’t pay her any money. My lawyer advised me to start paying immediately, two-hundred dollars every week.
When the trial was over the following April, I found out in May that I was to pay the full amount of child support from the day I left, 28JAN16 to catch up. That was seven thousand dollars. When I took my check stubs to the county showing that I had been faithful in paying my child support starting in May I was told by the lady who looked perfectly happy she was robbing me that, “See in the memo part of the checks, you didn’t write, ‘Child Support’”. I said, “Why else would I be giving her money?” The Blue Earth County Child Support Specialist then said, “You could have owed her that money, she said you didn’t pay her for a whole year, so that’s what you pay.”
To be fair my lawyer could have said something but maybe he didn’t know, I certainly didn’t know. If you know a single dad in Minnesota who is paying child-support in checks and just handing them to the ex-wife please tell them right away so they don’t get their money robbed from them.
My state taxes were then taken from me for 2016, and then because of the Blue Earth County Child Support Specialist who I had caught lying to me attempted to have them halted for 2017, she failed. These are really expensive lessons I am learning. Again, I would not make these claims unless I could back them up. As I like to tell my children, “The truth is a powerful thing to have on your side.”
Not all case workers are garbage, the Minnesota county I live in has a wonderful woman whose husband has also been raked over the coals. In fact she is the one who found out I was being lied to by Blue Earth. She got me and my fiancé food support that really helped us when we needed it. In a moment of financial woe we also had to go to the food shelf, we are not proud of this, but it was necessary, they are nice down there and did help us.
