Two valid criticisms against Dworkin Sandel seems to forget: (1) race is not a relevant criterion *in itself* with regards to admission to any institution no matter what the institution claims or (2) though institutions should be allowed to discriminate on whatever grounds they think is relevant, it doesn't make a case for discriminating for Blacks against Whites specifically, rather than the other way around.

In passing, assuming people owe part of their "characteristics" to their social "environment" (which both includes living and dead people, just saying), people with different characteristics in the beginning can end up with equivalent faculties, just as people evolving in comparable social environments can end up with widely different ones. So this unencumbered Rawlsian self doesn't prove a thing.
