Gaber Mohamed is starting The Racial Contract

For Marx, legal concepts of social relations, in terms of property and contract rights, replaced religion as fundamental ideological supports of capitalist social relations. For Durkheim, law replaced religion as the main embodiment of shared values and providing social solidarity. For Weber, the growth of law linked to the processes of rationalization which resulted from and replaced the Protestant ethic.

The acceptance of the fact that law is a component part of the wider social and political structure leads not only to the conclusion that academic lawyers should engage with other disciplines, but also suggests that other disciplines should engage with law.

If in the past, the question had been “Is Arab culture or Islam compatible with democracy?” the question and concern now became “Are the old guard and entrenched elites (military, courts, police and other political economic elites associated with the old regime) ready for the transition to democracy?"
